www.tractorsud.ro is managed by Tractor Sud S.R.L., located at Giurgiu, Street Gloriei nr. 3, Giurgiu county, Romania, Cod 080556, and holding registry certificate no J52/524/27.03.2019 and VAT no RO40860977.

We reserve the right to amend these current Terms and Conditions as well as the online store content at any time and without prior notice. Therefore, it is recommended that you regularly check the Terms and Conditions page for the latest updates.

Your Obligations on Registration

To be able to make any purchase on the www.tractorsud.ro online store, you need to enter your data on our website.

By using the service, you agree to provide your real, accurate, current, and complete data.

If we have reasons to believe you have failed to comply with this obligation, we reserve the right to restrict your access to using the service indefinitely or for a definite period of time, without further notice.

Fees and Payment Methods

Listed fees include VAT (19%).

The purchase fee on the invoice includes the fee listed on the online store at the time of the purchase, plus the shipping costs.

For your safety a Tractor Sud SRL representative will contact you by phone to verify each order. Immediately after telephone confirmation an invoice will be issued and you will receive a confirmation on email.

The contract is concluded at the moment when the invoice will be issued

Payment methods for purchases made on our website include and are not limited to cash upon purchase delivery or by credit card/debit card for orders placed online:

- online payment using your credit card while through PayU ePaymen secure online payment;

- cash on delivery;

- purchase order;

Information Related to Shipping

Orders are shipped in a maximum of 3 working days, starting with the day your order has been registered. This due date can change for reasons beyond our control.

Orders are delivered at the customer’s place of residence by FAN Courier’s Standard express courier service, within 24 hours average time since the order has been placed, and may be delivered to their destination in a maximum number of 48 hours.

Standard service is available in all FAN Courier coverage area for packages up to 150kg. For all shipping details and the complete list of the locations which do not register additional kilometres, click here

The shipping costs (including VAT) are:

- RON 16.50 for the first kg / destination

- RON 1.35 for each additional kg

- Additional cost of RON 0.80 for each km for shipments outside the FAN Courier in a single way

In case you wish to specify certain shipping details such as the delivery hour, the address, or any reference points, please enter them in the Notes field, before finalizing the order.

We will contact you by email or by phone on the day your parcel is being dispatched.

The parcel may be received by any member of your family.

Products can only be shipped if they are in stock. We will let you know if one or several of the products ordered are not in stock. In some cases, on your consent, a product you have ordered may be replaced with a similar product.

We cannot be held responsible for any damages brought upon the product or the parcel dispatched by us. According to the rules in force, the shipping company is responsible for the safe delivery of your order. If the shipping company is made accountable for the damage and we are notified about it within 24 hours upon receiving the product, we will replace the product you have ordered.

Confidentiality Policy

In case of litigations and disputes with regard to payment frauds with entities such as the Banks involved in the online payment process, the International Card Organizations and Service/Product Providers, personal data may be divulged without further notice to the institutions in force.

According to Law No. 677/2001, our customers have the following rights:

1) The right to information (article 12);

2) The right to access data (article 13) – the right to obtain on request and free of charge a status on whether personal data is being processed by the data operator or not;

3) The right to intervene (article 14) – the right to make a free-of-charge written request to the data operator for the following:

a) reamending, updating, blocking or erasing incomplete, inaccurate, or illegally processed data;

b) illegal transformation of personal data into anonymous data;

c) third-party notifications with regard to the operations listed under a) and b).;

4) The right to oppose (article 15) – the right to oppose through a free-of-charge written request for solid and pertinent reasons related to a particular context where data becomes subject to processing;

5) The right to go to court (article 19) – the right to go to court to defend rights that are guaranteed by law, but have been transgressed;

6) The right to make a complaint towards the supervisory authority (article 25);

Responsibilities with Regard to the Products

Tractor Sud S.R.L does not take any responsibility and cannot be held responsible for any damages caused by the misuse or the use of products purchased via this online store for other purposes than those indicated by the manufacturer. Limitations with Regard to the Use of Particular Telecommunication Techniques

Article 1 – The following telecommunication techniques require the customer’s prior consent:

a) automatic calling system without human intervention (robocalling);

b) telefax (fax);

c) electronic mail (e-mail);

Article 2 – The use of other individual telecommunication techniques except for the ones described by Article 1 is not allowed, if the customer refuses them;

The list of telecommunication techniques comprises the following:

a) unaddressed form;

b) addressed form;

c) template letter;

d) printed advertising with purchase order;

e) catalogue;

f) ordinary telephone system, with human intervention;

g) automatic dialing telephone system (robocalls, audio-texting);

h) radio;

i) videophone (phone with video feature);

j) videotext (mini-computer, TV screen with keyboard or touchscreen);

k) electronic mail (e-mail);

l) telefax (fax);

m) television (teleshopping);

Litigations

Once you have used, viewed or purchased a product on our website, as a user, you agree that the Terms and Conditions herein and any conflict that might arise between the user and Tractor Sud S.R.L. are subject to the Romanian regulation in force. In case of any conflicts between Tractor Sud S.R.L. and its customers, an attempt to deal with them amicably will be made within a minimum of 30 working days.

If an amicable solution cannot be reached, such conflicts will be addressed by a competent institution according to the Romanian laws in force.

Other specifications

If any of the clauses above shall be found null and void, regardless of the cause, it will not conflict with the validity of the others clauses herein. Once the order has been launched, the customer agrees to be bound by and comply with these Terms and Conditions without any objection. Their value stands for a valid contract agreed by both parties.

By agreeing with these Terms and Conditions, the customer completely acknowledges the rights and obligations deriving from any purchase on the www.tractorsud.ro online store.
